This cause came to be heard on the record on appeal from the United States District Court for the District of Columbia and was argued by counsel. On consideration thereof and in accordance with the opinion of the court filed herein this date. It is

ORDERED and ADJUDGED that the judgment of the District Court be vacated and the case be remanded for the District Court to determine whether Russia is entitled to sovereign immunity or if the arbitration exception to the FSIA applies. In making this jurisdictional determination, the district court should also consider whether the Dutch courts’ judgments on this question are entitled to preclusive effect.
