SCC Arbitration V (2015/092): Littop Enterprises Limited et al - v - Ukraine

Further to our telephone CMC last Wednesday, 1 November 2017, and the Latham & Watkins' email of 6 November, I confirm that:

(1) the hearing in this matter will now take place during the weeks commencing 8 and 22 October 2018; and

(2) the previously reserved dates of 19 February to 2 March 2018 are now released.

Without prejudice to the seat of this arbitration being in Stockholm, as agreed the hearing will take place in London. The parties should make the necessary reservations at the IDRC for the weeks commencing 8 and 22 October 2018.

The Tribunal notes the parties' preference for a consecutive two week hearing and have asked the Tribunal to reserve the weeks commencing 12, 19 and 26 November 2018 pending discussion between them. One member of the Tribunal is not available in the week commencing 12 November. The Tribunal has reserved the 2 weeks commencing 19 and 26 November 2018. You will appreciate that we cannot keep these dates reserved for too long. Accordingly, the parties are requested to advise the Tribunal if any agreement has been reached to use these two weeks (instead of 8 and 22 October 2018) by 4 December 2017.

Respondent's Counsel expressed concern during the CMC at the proposed use of the Opus system as it will host sensitive documents. The Tribunal considers that in view of the size of the files in this arbitration, an electronic system available to all participants would be beneficial, especially at the hearing. Respondent was to review this issue concerning security, and would seek to agree, at first instance, with Claimant. If no agreement is reached, the parties may revert to the Tribunal.

I attach the Procedural Timetable revised as of today's date in which I have amended paragraph 34 to reflect the new hearing date. Counsel should please seek to agree between themselves paragraphs 28 to 33.
