Re: PCA Case No. 2016-14: JSC Oschadbank v. The Russian Federation

Dear Colleagues,

We write with respect to the arbitration proceedings between JSC Oschadbank (“Oschadbank”) and the Russian Federation under the Agreement between the Government of the Russian Federation and the Cabinet of Ministers of Ukraine on the Encouragement and Mutual Protection of Investments dated 27 November 1998 and the Arbitration Rules of the United Nations Commission on International Trade Law 1976 (“UNCITRAL Rules”).

By way of the present correspondence, the Russian Federation seeks the resumption of these arbitration proceedings, specifically for the adjudication of the Application for Revision of the Award dated 26 November 2018 instituted by the Russian Federation on 19 August 2019, pursuant to Article 1502 of the French Code of Civil Procedure (“Revision Application”). To this end, the Russian Federation makes two remarks.

1./ In its recent judgment dated 23 June 2026, the Paris Cour d'appel has annulled the original arbitral tribunal's Decision on Claimant's Request to Dismiss the Respondent's Application for the Revision of the Award dated 11 December 2023, whereby the Russian Federation's Revision Application had been dismissed without consideration on the merits (“Revision Award”).1 As a consequence of this annulment of the Revision Award, the Russian Federation's Revision Application remains undecided and must be adjudicated afresh by an arbitral tribunal, pursuant to Article 1502 of the French Code of Civil Procedure. Accordingly, the Russian Federation requests the PCA to resume these arbitration proceedings, notably for the adjudication of the Russian Federation's Revision Application afresh.
