UNITED STATES DISTRICT COURT

FOR THE DISTRICT OF COLUMBIA

MOL HUNGARIAN OIL AND GAS PLC,

Petitioner,

v.

REPUBLIC OF CROATIA,

Respondent.

Civil Action No. 23-00218 (АНА)

Order and Judgment

For the reasons stated in the court's memorandum opinion, ECF No. 59, the arbitral award issued on July 5, 2022, in ICSID Case No. ARB/13/32 is enforced in the same manner as if it were a final judgment of a court of general jurisdiction in one of the several states.

Judgment is entered in favor of Petitioner in the amount of $286,130,794.52, as of the date of this judgment, plus post-judgment interest at the rate specified in 28 U.S.C. § 1961, from the date of this judgment until the judgment is satisfied.1

1 The parties jointly proposed a final judgment, agreeing on all issues except the applicable post-judgment interest rate. See ECF Nos. 62, 62-1. “Courts in this district have generally applied Section 1961(a) to judgments enforcing ICSID awards.” Order at 1 n.1, Infrastructure Servs. Luxembourg S.A.R.L. v. Kingdom of Spain, No. 18-cv-01753 (D.D.C. Sept. 30, 2025), ECF No. 117 (collecting cases); see Judgment at 2 n.1, Blasket Renewable Invs., LLC v. Kingdom of Spain, No. 23-cv-02701 (D.D.C. Nov. 15, 2024), ECF No. 28 (collecting cases); Blasket Renewable Invs., LLC v. Kingdom of Spain, No. 20-cv-00817, 2025 WL 3268233, at *5 (D.D.C. Nov. 24, 2025) (concluding “postjudgment interest is a judgment enforcement mechanism, not a ‘pecuniary obligation’ owed full faith and credit under the ICSID Act,” and applying Section 1961(a)). Indeed, that rate is “mandatory, unless the parties agree to a different rate by clear, unambiguous, and unequivocal language or the arbitral award itself explicitly states the interest rate to be applied post-judgment.” Order at 2 n.1, Infrastructure Servs. Luxembourg S.A.R.L., No. 18-cv-01753, ECF No. 117 (cleaned up) (quoting Archirodon Constr. (Overseas) Co. v. Gen. Co. for Ports of Iraq, No. 22-cv-01571, 2024 WL 341066, at *7 (D.D.C. Jan. 30, 2024)). Because neither exception applies here, the court awards Petitioner post-judgment interest at the rate specified in 28 U.S.C. § 1961. ↩
