Applicant Sacyr S.A. (“Sacyr”) hereby gives notice of its voluntary dismissal of the instant action without prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1)(A). This Notice of Voluntary Dismissal is submitted solely by Sacyr and without prejudice or effect to applicant Webuild S.p.A.’s Ex Parte Application for discovery pursuant to 28 U.S.C. § 1728 (ECF 1).
This action is still at an early stage. Pursuant to Rule 41, no party has filed an answer, motion for summary judgment, or counterclaim. See Fed. R. Civ. Proc. 41.
Accordingly, Sacyr provides notice of its voluntary dismissal of this action without prejudice.
