I. INTRODUCTION

Pursuant to the schedule set out in Procedural Order No. 3 (as amended by the Tribunal’s email of 9 November 2020), the Parties and the Tribunal held the hearing on jurisdiction on 29 September and 10, 11 and 13 November 2020 (the “Hearing”).

At the close of the Hearing, the Parties and the Tribunal discussed and agreed on the organization of the post-Hearing procedure. Pursuant to this discussion, the Tribunal issues this Procedural Order No. 4 to govern the organization of the post-hearing matters.

II. COMMENTS ON THE U.S. ORAL PRESENTATION

1. By 11 December 2020, the Parties shall file simultaneous written submissions, commenting on the oral presentation made by the United States on the last day of the Hearing.

2. Each submission shall contain no more than 8,000 words, excluding footnotes provided the footnotes contain no submissions but only citations to sources.

III. TRANSCRIPT CORRECTIONS

3. The Parties shall endeavor to agree on the corrections to the Hearing transcripts by 4 December 2020, failing which the Tribunal will resolve any disagreement.

IV. COST STATEMENTS

4. The Parties shall file their cost statements by 15 January 2021. The cost statements shall include itemization of the costs claimed, without providing arguments on the allocation of costs.

5. The cost statements need not include any supporting documentation, unless one of the Parties so requests by 20 January 2021, or the Tribunal so directs.

6. The Parties will not comment on the opposing Party’s cost statement, unless one of the Parties requests leave to do so by 20 January 2021.

V. PROGRESS REPORT

7. The Tribunal will endeavor to apprise the Parties of the progress of its deliberations in mid-February 2021.
